Nearly Ten lakhs Central Government employees took part in the one day token strike today, the 12th December, 2012 on the call of the Confederation of Central Government employees and workers, paralyzing the governmental functions in various departments throughout the country.  The strike was to protest against the continued efforts of the Government to enact the PFRDA Bill, whereby the existing defined benefit pension of Government employees is sought to be converted into a defined contributory pension scheme.  Every reason, the Government advanced at the time of the introduction of the new scheme is found to be incorrect and misleading by the Experts Committee set up by the Government itself.

Besides, the employees had been demanding wage revision by setting up the 7th Central Pay Commission, filling up large number of vacant posts, regularization of the service of Grameen Dak Sewaks/Casual/daily-rated workers, revival of the negotiating machinery i.e. JCM, removal of restrictions on compassionate appointments, introduction of Public Distribution system to arrest the ever increasing prices of essential commodities, stoppage of outsourcing, contractorisation, privatization etc. 

As per the report received the strike was total in Assam, Tripura, West Bengal, Orissa, Andhra Pradesh, Tamilnadu, Kerala, Chattisgarh, Jharkhand and beyond 80% in Maharashtra, Karnataka, U.P. Bihar, and about 60% in other States.  The Postal, Income tax, Groundwater Board departments came to a grinding halt in all States,  as the offices could not be opened at all. In Income tax Department, the promotee officers also joined the strike paving way of a complete closure.  Many establishments of Atomic Energy, Printing and Stationery, Defence accounts, Medical Depots, Audit and Accounts  Departments, Civil Accounts, CGHS, Indian Bureau of Mines, Directorate of Marketing Inspection, Geological Survey of India, Archaeological  and Botanical Survey of India etc. remained closed. 

The organizers of the Strike have asserted that they will make the general strike of workers slated for 20th and 21st February, 2013 a grand success by enlisting participation of  all sections of the Central Government employees. 

The Confederation will strive to organize an indefinite strike in pursuance of the 15 point charter of demands in 2013 if no settlement is brought about by the Government by then.

Shri Basudeb Acharya.   Finance.                              This house disapproves the proposal of the Government to reject the award given on 24th November, 2005 by the Board of Arbitration in CA Reference case No. 3 of 2004 regarding revision of rates of transport allowance to the Central Government employees as the expenditure to be incurred is not going to be Rs. 1232 crores.   The increased allowance is to be given for only two months i.e. November, 2005 and December, 2005 as Transport allowance at much higher rates has already been paid from 1.1.2006 onwards.

Finance                                  This house disapproves the proposal of the Government to reject the award given on 6.4.2004 by the Board of Arbitration in CA reference case No. 2 of 2002 regarding grant of house rent allowance to the Central Government employees for the period from 1.1.2996 to 31.7.1997  at pre revised rates but with reference to revised pay.  This is only a one time expenditure for the period of 19 months and logically to be related to the revised pay as was obtaining at the relevant point of time.  Since this expenditure will be met from the savings in the Budget under the head Salaries no diversion of any funds are to take place.

Subject:                          Provisions relating to proforma promotion.

Undersigned is directed to refer to this Department's OM No. 6/8/2009-Estt (Pay-II) dated the 17th June, 2010 regarding consolidated instructions on deputations. References are being received from Ministries/Departments seeking clarifications/relaxations in respect of provisions which pertain to proforma promotion in these orders or otherwise. The issues have been considered in consultation with the Department of Expenditure, and it has been decided to provide as under:

(i) Proforma promotion in the case of candidates promoted on passing a Limited Departmental Examination

The candidates passing the Limited Departmental Examination may be
allowed proforma promotion as under:  In the case of candidates who have passed the LDCE and their names have  been recommended for promotion, proforma promotions may be allowed  from the date their juniors in the cadre in the order of merit in the LDCE  have been so promoted. This may also be allowed in case there is no junior on account of such candidate being the last in the order of ranks/merit from the date he would have received such promotion if he had been in his cadre.  Provided it will be ensured that the conditions laid down in the Department of  Personnel OM No.8/4/84-Estt-(Pay-I) dated the 15 th  July, 1985 are strictly  fulfilled and the principle of NBR based on overall seniority list of cadres is  followed.

(ii)        Extension after the employee receives a proforma promotion:   The para 8.6 of the OM No. 6/8/2009-Estt (Pay-II) dated the 17 th  June,  2010 relating to regulation of pay after an officer has got proforma promotion and extension of deputation thereafter, which reads as  under:

"If the Grade pay of the officer in the parent cadre becomes higher than  that of the deputation post after getting proforma promotion, he may be  allowed the pay in the pay band + Grade Pay of the post to which he  is promoted till the time he completes the normal/ extended period of  deputation (if he gets proforma promotion in the extended  period) already sanctioned, if he so opts. No extension in the period of  deputation shall be allowed to him after completing the sanctioned period  of deputation."

is modified as follows:

8.6       (a)If the Grade pay of the officer in the parent cadre becomes higher  than that of the deputation post after getting proforma promotion, he may  be allowed the pay in the pay band + Grade Pay of the post to which  he is promoted, if he so opts. In such cases, extensions in deputation after an employee has received the proforma promotion may be considered as per the instructions contained in paras 8.1 to 8.3.2.

NEWS IN BRIEF


1. Meeting with the Staff side on “IT Modernisation Project of Department of Posts” held on 30.11.2012. Ms. P. Gopinath, Member (Technology), Postal Services Board, made the presentation and clarified all the queries raised by the staff side. Secretary Generals of NFPE & FNPO and General Secretaries of all Unions/Associations attended the meeting. The presentation made by the Department is exhibited in the website.

2.  Periodical meeting of Secretary, Department of Posts with NFPE & FNPO and its affiliated Unions/Associations was held on 30.11.2012. All notified items were discussed. Minutes will be published later.

3.  Secretary, Department of Posts has informed that the next JCM Departmental Council meeting will be held during the last week of December 2012. New items for discussion will be submitted by the staff side shortly. It is also assured to hold a standing committee meeting of the JCM Departmental council under the Chairpersonship of Member (Personnel), Postal Services Board to discuss the pending items of the Departmental Council.

4.  Federal Secretariat of NFPE met on 29.11.2012 and reviewed the campaign and preparations for the 12th December 2012 strike. Secretary General and all the General Secretaries of affiliated unions attended the meeting. A detailed review was conducted. It is observed that this time the percentage of the participation of employees in the strike will be an all time high. It is decided to continue the campaign intensively with more vigour in the remaining days and make the 12th December strike a grand success.

5.  The Central Zone Study Camp of NFPE will be held on 19th and 20thJanuary 2013 at Vidisha (Madhya Pradesh). The revised quota allotted to each circle union is published in the website. All Circle Secretaries are requested to ensure that delegates as per quota allotted participate in the camp. Up and down tickets may be booked immediately.

6. The 1st All India Conference of the newly formed GDS Union, AIPEU-GDS (NFPE) will be held at Chennai during the last week of March 2013.
MACP TO PROMOTEES = DEPARTMENT’S STAND = LATEST POSITION
APPEAL FILED IN JODHPUR HIGH COURT AGAINST CAT JUDGEMENT

Para – 9 of the Annexure – I to DOP&T OM dated 19.05.2009 provides in clearest terms that “regular service for the purpose of MACPS shall commence from the date of joining of the post in direct entry grade on a regular basis or on absorption/re-employment basis.”

The existing statutory Recruitment Rules of Postmen and PA cadre provide for promotion quota to be filled up through LDCE (Limited Departmental Competitive Examination). Para – 5 of Annexure – I of DOPT Order on MACPS provides for ignoring only the promotions/upgradations granted under the ACP scheme (old scheme) in the past to those grades which now carry the same grade pay due to merger of pay scales/up gradation of posts recommended by 6th CPC. Thus the promotions earned through LDCE are not provided to be ignored.

As per the summary record of discussions of the meeting held on 27.07.2012 with the JCM National Council Staff side on issues relating to MACPS (Annexure III to DOP&T OM No 11/2/2008-JCA dated 13.09.2012) it was decided against item No. 4 that treatment of such cases would be on the lines as was under the ACP scheme (old scheme) and Ministry of Railways would examine the matter accordingly. Para 5.1 of Annexure-I to DOP&T OM dated 09.08.1999 relating to ACP Scheme (old scheme) provides for counting of regular promotions earned through LDCE.

So far as the common Judgment of the CAT Jodhpur in OA No. 382/2011, 353/2011 and 354/2011 dated 22.05.2012 is concerned, the CAT held that whenever and official appears in LDCE and gets selected to the post, them it starts new innings for him and for the purpose of counting his stagnation, if any, from the date of joining of the new post alone would be relevant and his previous career advancement cannot be called as promotion within the definition of the word “promotion” for consideration of his eligibility under MACP scheme.

The judgment referred to above is in contradiction to the provisions of the MACPS as also against the decision of the Government against item No. 4 referred to in Annexure – III to DOP&T OM No. 11/2/2008-JCA dated 13.09.2012.

MACP Scheme is the Scheme formulated by DOP&T, the nodal Ministry in this regard. Department of Posts cannot make any change in the scheme. The Department has accordingly referred the issue to the DOP&T and provided the required Recruitment Rules as called for by the DOP&T.

Keeping in view of the existing provisions of the MACP Scheme as also the decision of the Government against item No. 4, Department has filed writ petition (Appeal) before the Hon’ble High court of Jodhpur.

Revision of wages of Casual Labourers

Sub: -  Revision of wages of Casual, Part-time contingent employees of the Department of Posts w.e.f. 01.01.2006.

Kindly recall the discussion I had with you on the above subject.

As per the Judgment of the Supreme Court the Casual, Part-time, contingent employees whose nature of work is same as of regular employees, i.e; Fulltime/part-time Chowkidar/Farash/Mali/Sweeper etc. are eligible for pro-rata wages with reference to the minimum wage of the similarly placed regular employees. Accordingly after implementation of 5th CPC recommendations, the Department of Posts has issued orders for payment of pro-rate wages to casual, part-time, contingent employees with effect from 01.01.1996, duly approved by the Department of Personnel and Training. Copy of the Memo No. 1-3/97-PAP dated 03.11.1998 is enclosed herewith in which it is clearly stated as follows:

“It has now been decided that notwithstanding that the CCS (RP) Rules, 1997 do not apply to them, the remuneration of the aforesaid Full Time Casual Labour (Other than Temporary Status)/Part Time Casual Labour/Workers engaged on contingency basis whose nature of work is the same as of regular employees i.e. Part Time Chowkidar/Farash/Mali/Sweeper etc. who are not engaged for Post office operative work and are being paid as per instructions contained in this office letter No. 45/95/87-SPB.I dated the 10th February, 1988 and Department of Personnel & Training O. M. No. 49014/2/86-Estt (C) dated the 7th June 1988 shall be remunerated on pro rata basis with reference to the minimum of the pay scale of Group ‘D’ as per CCS (RP) Rules, 1997 plus admissible Dearness Allowance thereon only.

It is further clarified by the DOP&T that they are eligible for pro-rata wages w.e.f. 01.01.1996 i.e the date of implementation of the 5th CPC recommendations. (Copies of both the above cited letters are enclosed herewith for your ready reference).

From the above it is clear that the casual, part-time and contingent employees of the Department of Posts are eligible for revision of their wages on pro-rata basis with effect from 01.01.2006, on revision of wages of the Central Government Employees. The  stand taken by the Department of Personnel & Training  that there is no Group D scale now, does not appear to be correct as sixth CPC has already fixed the minimum wage as – IS scale and Government has already issued orders in this regard.

I once again request you to cause issue of orders for revision of their wages at an early date as it is long overdue.

CENTRAL GOVERNMENT EMPLOYEES V/S GLOBALISATION POLICIES

More than ten lakhs Central Government employees including Postal employees are determined to go on nationwide strike on 12th December 2012. Strike notice to Cabinet Secretary and Secretary, Department of Posts has already been served on 19th November 2012. The 26th July Parliament march in which more than 20000 employees participated, itself is a manifestation of the growing discontentment among the Central Government employees.
There was about 36 lakhs Central Government employees prior to 1990. The downsizing policy implemented by the Central Government during the last two decades has resulted in reduction of about 8 lakh posts and the total number of employees has come down to 28 lakhs. More and more Government functions are being outsourced. Contractorisation and privatization has become the order of the day. More than four lakhs posts are lying vacant in Central Services. Workload has increased but filling up of vacant posts and creation of new posts are not taking place.
Prices of essential commodities are shooting up. Deregulation of petroleum prices, withdrawal of subsidies including Kerosene and cooking gas, dismantling of public distribution system, futures trading, hoarding by black marketers etc. has resulted in unprecedented price rise especially of essential commodities. As a result large scale erosion has taken place in the real wages of the employees and workers, DA granted is not in commensurate with the price rise. In these circumstances, appointment of 7th Central Pay Commission should not be delayed any further. The three lakhs Gramin Dak Sevaks of the Postal department should also be brought under the purview of the Pay Commission. The demands for departmentalization of GDS and extension of all the benefits of the departmental employees should be considered favourably by the Government.
The Contributory Pension scheme is nothing but a farce. Under this scheme there is no guarantee that an employees will get minimum eligible pension at the time of retirement. Everything depends upon the vagaries of share market. During the last economic recession which started from USA, pension funds had collapsed and lakhs and lakhs of people are forced to live without any social security or pension.

Merger of DA with pay, removal of restrictions on compassionate appointments, revision of wages and regularization of casual labourers, removal of bonus ceiling and discrimination in bonus to GDS, non functioning of JCM forums, non-implementations of Arbitration awards, Revision of OTA and Night duty allowance, grant of five promotions, Right to Strike and trade union victimizations are the other demands raised by the confederation of Central Government Employees and workers in the strike charter.

          Intensive campaign is going on in all states and no doubt, the 12th December strike will be one of most successfull strike of the Central Government employees.

NFPE calls upon the Postal & RMS employees including Gramin Dak Sewaks to join the strike en-masse and make the strike a historic success.
