OFFICE MEMORANDUM

Subject: Official dealings between the Administration and Members of Parliament and State legislatures - Observance of proper procedure.

The undersigned is directed to refer to this Department’s Office Memorandum No. 11013/4/2011-Estt.(A) dated 1st December 2011 subsequently reiterated vide D.O. letter dated the October 9, 2012 from Secretary (Personnel), O.M. No. 11013/2/2012-Estt.A. dated 19.11.2014 and O.M. of even No. dated 7.02.2018 (copies enclosed) on the subject mentioned above and to reiterate these instructions for strict compliance on the recommendations of the Committee of Privileges, Lok Sabha in its Sixth Report tabled in the Lok Sabha on 20.12.2017 and Committee on Violation of Protocol Norms and Contemptuous Behaviour of Government Officers with Members of Lok Sabha in its Fourth and Fifth Report tabled in the Lok Sabha on 01.08.2018.

2.         All Ministries/ Departments are requested to ensure that instructions issued through aforementioned communications are followed by all officials concerned, both in letter and spirit. Violation of these guidelines will be viewed seriously.

3.         Chief Secretaries of all States/ UTs are requested circulate these instructions to all State Government officials at the State/ Division and District levels and sensitize them with regard to their duties and obligations in so far as the movement of Members of Parliament in general and more particularly during Parliament sessions. It is also requested to periodically review implementation of these instructions.

O R D E R
(a) The impugned judgment and order dated 16th April, 2013 made by the CAT is hereby set aside.

(b) The petitioner is held entitled to receive the benefit of MACP with effect from 1st January, 2006 together with all consequential benefits.

(c) The respondents are directed to work out the benefits of MACP with effect from 1st January, 2006 together with consequential benefits and to pay the same to the petitioner as expeditiously as possible and in any case within a period of three months from today.

(d) If, such benefits/consequential benefits are not paid to the petitioner within three months from today, then the respondents will liable to pay interest thereon @ 6% p.a. from the date such payments became due and payable, till the date of actual payment.

(e) Rule is made absolute in the aforesaid terms. There shall however be no order as to costs.

             Your  kind attention is invited towards the above mentioned orders of Directorate regarding payment of Bonus to the Postal Staff.
            In this connection, it is worth mentioning here that due to CSI Roll out, there will be problem in payment of bonus at so many places.
            We are receiving complaints from so many circles that the arrear of D.A has not been paid to the employees yet because of CSI Problem.
            The bonus is paid to celebrate Durga Puja and Dussera and if employees will not get Bonus, then they will get disappointed.
            Further there are two bank holidays and two Gazetted holiday starting from 18th to 20th Oct 2018.
            The payment is also less then Rs twenty thoushand only.
            In the view of the above facts, we would like to urge upon you to kindly issue instructions to all CPMGs and GMs/ Finance / DAPs to make payment of bonus in cash.
           
An immediate action is highly solicited.
