Comrades,

            The Government of India , Ministry of Finance  has  again rejected  the demand of PJCA  for inclusion of  matters relating to  GDS  Wages  revision  and other service conditions in 7th CPC . During the meetings onPJCA  6th May, 2015  Strike Charter of Demands  Postal Board and Communication  Minister  has assured  that a strong  note  with strong recommendations will be  sent to  Finance Ministry for inclusion  of GDS  in 7th CPC . But unfortunately  it has been rejected  once again and it  shows  the thinking of  Government of India  towards  this most deprived  and exploited  section of  Postal Department . It has come to notice that Department has started action to form Bureaucratic Committee which requires to be protested strongly. Besides this the file of Cadre restructuring has been sent back by DOP&T for clarification on some points. Though we  were  assured by the Department  that all Cadre Restructuring  proposals  will be implemented  before 7th CPC.

            In all cadres of Postal Department, there is acute shortage and no appropriate action is being taken by the Postal Board to fill up the vacancies.

            Hence  being  aggrieved  we strongly  oppose all these moves of Government of India and  Department of Post, and to protest all these  things  the following  programme of action is declared for the below mentioned Demands: -

(i)     Include GDS in 7th CPC for wage revision and other service related matters.
(ii)    Implement cadre Restructuring proposals in all cadres including Postal Accounts and MMS in Department of Posts
(iii)   Fill up all vacant posts in all cadres of Department of Posts(i.e. PA,SA, Postmen, Mail Guard, Mail Man, GDS Mail Man, MMS Driver & other staff in MMS, PA CO, PA SBCO , PO Accounts & Civil Wing  Staff)
   
PROGRAMMES -

1.      Observe protest day on 19th August 2015 by observing lunch hour demonstration in front of all Divisional, Regional and Circle offices.

2.   One Day Dharna on 26th August 2015 at all Divisional, Regional and Circle Offices.

3.   One Day Dharna by All India Leaders of PJCA (NFPE+FNPO+AIPEU GDS (NFPE) + NUGDS) in front of Dak Bhawan (Postal Directorate) New Delhi on22nd September-2015)

            Postal JCA appeals entire  rank and file to make  all efforts to make all agitational  programmes  a grand success to give a  strong message  to Government of India  and Department of Posts  that if  our genuine  demands are not settled the Postal Employees  including GDS  will be compelled to go  on Indefinite Strike.

Sub: Restoration of the erstwhile Group-D posts and regularisiation of the services of Contract! Casual Employees.

 Introduction

During the course of oral evidence of the Staff side of the National Council(JCM), with the 7th CPC, while discussing on chapter 17, para no.17.1, 17.4.2 to 17.5:5 of the memorandum submitted by the Staff side of the National Council(JCM), the staff side stated that a large number of contract/casual, contingent and daily rated workers are deployed in various Central Govt. Establishments including Railways, Defence, postal, Income Tax and Accounts & Audit etc. especially in the jobs performed by the erstwhile Group-D Employees such as Chowkidar, Safaiwalas, Peons, Mali, Washèrman etc. The Chairman of the 7th CPC afte, listening to the views putforth by the Staff side in this regard has desired that the Staff side may give their views in writing for restoration of the erstwhile Group-D posts in Central Govt. Establishments. Accordingly the following note is submitted for the favourable consideration of the 7th CPC.





REPORT OF J&K CIRCLE CONFERENCE:-  The Circle Conference of All India RMS & MMS Employees Union Group `C` of J&K circle was held at Jammu from 12th to 13th August, 2015 under the Presidentship of Com. Razia Begum. Com. Giri Raj Singh General Secretary R-III and President NFPE inaugurated  the Open Session and elaborately spoke on Task Force Committee Report, Cadre Review, MACP anomalies, filling up vacant posts, OTA Rate, Charter of Demands of 2nd September, 2015 One Day Strike and indefinite Strike from 23rd November, 2015 including 7 CPC issues, Five Promotions, date of effect 01-01-2014, date of increment January & July etc. and appealed to all to mobilize rank & file to participate and make  an grand success 2nd Spt. 2015 One Day Nation wide Strike and Indefinite Strike from 23rd November, 2015. Coms.  
Surender Kumar Circle Secretary , Razia Begum Divisional Secretary and other leaders addressed the Conference.
Coms Rajesh, Razia Begum  and Com. Ranjit Kumar  were elected as Circle President, Circle Secretary and Treasurer respectively.

PAID LEAVE FOR SEXUAL HARASSMENT VICTIMS 
((PMIN OF PERSONNEL, PUBLIC GRIEVANCES & PENSIONS
            Instructions have been issued by this Department vide Office Memorandum dated 27.11.2014 regarding Alignment of Service Rules with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013. As per para 6 of the said Office Memorandum, the Complaint Committee will have the powers to recommend to the employer (a) to transfer the aggrieved woman or the charged officer to any other workplace; or (b) to grant leave to the aggrieved woman up to a period of three months, which will be in addition to the leave she would be otherwise entitled to.
            As per Section 9 of Chapter IV of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013, any aggrieved woman may make, in writing, a complaint of sexual harassment at workplace to the Internal Committee within a period of three months from the date of incident and in case of a series of incidents, within a period of three months from the date of last incident. 
            The Committee may, for the reasons to be recorded in writing, extend the time limit not exceeding three months, if it is satisfied that the circumstances were such which prevented the woman from filing a complaint within the said period.

            This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shri P.Nagarajan and Shri B. Vinod Kumar in the Lok Sabha today. 

7th Pay Panel: Salary expenditure of central government staff to exceed Rs 1 lakh crore in FY'16

NEW DELHI: Central government's salary expenditure will exceed Rs 1 lakh crore in the current fiscal and is projected to increase further with the recommendations of 7th Pay Commission, posing risk to public finances, Finance Ministry said today.

According to the Medium-Term Expenditure Framework Statement tabled in Parliament, the salary outgo of central government employees will go up by 9.56 per cent to Rs 1,00,619 crore in current fiscal.

The pace will increase further in 2016-17 at 15.79 per cent to Rs 1.16 lakh crore with the likely implementation of the 7th Pay Commission award, said the statement tabled by Finance Minister Arun Jaitley in Parliament.

The outgo towards salary will further rise in 2017-18 to over Rs 1.28 lakh crore.

"The award of VII Central Pay Commission (CPC) and its impact on government finances poses a risk," said the statement.

It also raised concerns about the rising pension bill of government employees saying it will rise to Rs 88,521 crore in current fiscal. It has been pegged at over Rs 1.02 lakh crore in 2016-17, and over Rs 1.12 lakh crore in 2017-18.

"Like in salaries, higher than normative growth has been provided for the projection of outlay on pensions during 2016-17. For the second year of the projection (2017-18), a normative growth has been assumed. Award of VII CPC and its impact on Government finances poses a risk," it added.

The recommendations of the 7th Pay Commission, which was set up by in February 2014, is likely to be implemented from January 1, next year.

ANNEXURE – I
PART-I
1.    Urgent measures for containing price-rise through universalisation of public distribution system and banning speculative trade in commodity market.
2.    Containing unemployment through concrete measures for employment generation.
3.    Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measure for violation for labour laws.
4.    Universal social security cover for all workers
5.    Minimum wages of not less than Rs. 15,000/- per month with provisions of indexation.
6.    Assured enhanced pension not less than Rs. 3000/- P.M. for the entire working population.
7.    Stoppage of disinvestment in Central/State PSUs.
8.    Stoppage of contractorisation in permanent perennial work and payment of same wage and benefits for contract workers as regular workers for same and similar work.
9.    Removal of all ceilings on payment and eligibility of bonus, provident fund; increase the quantum of gratuity.
10. Compulsory registration of trade unions within a period of 45 days from the date of submitting applications; and immediate ratification of ILO Convention C 87 and C 98.
11. Against Labour Law Amendments
12. Against FDI in Railways, Insurance and Defence.

PART-II
1.    Effect wage revision of the Central Government Employees from 01.01.2014 accepting memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA; Include Gramin Dak Sevaks within the ambit of 7th CPC. Settle all anomalies of 6th CPC.
2.    Implement Cadre restructuring proposal in all Cadres including MMS.
3.    Implement arbitration awards and revise OTA Rates.
4.    No Privatisation, PPP or FDI in Railways, Defence Establishment and no corporatization of Postal services.
5.    No ban on creation of new posts. Fill up all vacant posts.
6.    Scrap PFRDA Act an re-introduce the defined benefit statutory pension scheme.
7.    No outsourcing, contractrisation, privatization of governmental functions; withdraw the proposed move to close down the printing presses, the publications, form stores and stationery departments and medical stores Depots; regularize the existing daily-rated/casual and contract workers and absorption of trained apprentices.
8.    Revive the JCM functioning at all level as an effective negotiating forum for settlement of the demands of the Central Government Employees.
9.    Remove arbitrary ceiling on compassionate appointment.
10. No labour reforms which are inimical to the interest of the workers.
11. Remove the ceiling on payment on bonus
12. Ensure five promotions in the service career.
