7^th CENTRAL PAY COMISSION AT NEW DELHI

A meeting of NFPE Leaders consisting Coms. R.N. Parashar Secretary General NFPE, Giriraj Singh , General Secretary-R-III, N. Subramanian General Secretary P-III, R. Seethalakshmi General Secretary P-IV, P. Suresh  General Secretary R-IV , Pranab Bhattacharya General Secretary Admn., T. Satyanarayana General Secretary Postal Accounts, Virendra Tiwari General Secretary AIPSBCOEA, Pandu Ranga Rao General Secretary GDS(NFPE), R. Shivanarayana President P-III, S.K. Bardhan President R-III, S.P. Kulkarni President AIPSBCOEA, Balwinder Singh Treasurer P-III, Manohar Lal  Vice President P-IV,K.P.Singh AGS R-III was held with Chairman of 7^th CPC Justice A.K. Mathur alongwith Smt. Meena Agrawal , Secretary, Shri Jayanyt Sinha Jt. Secretary , Shri Vivek Rae Member, Shri Y. Shukla, Director, Shri Rajeev Mishra Advisor, Shri Mudit  Mittal Director, at 7^th CPC Office Chhatrapati Shivaji Bhawan Qutab Institutional Area , New Delhi.

Com. R.N. Parashar, Secretary General NFPE after welcoming Chairman & other members initiated oral evidence on memorandum submitted by NFPE. He narrated all important points related to Postal, RMS, MMS, Admn, Offices, Postal Accounts, SBCO and GDS issues alongwith Casual Labourers issues. All General Secretaries of NFPE affiliated unions presented their sectional issues very nicely.

The most important thing of this meeting was that Chairman gave a patient hearing on GDS issues. Com. P. Panduranga Rao General Secretary, GDS (NFPE) presented the case of GDS in perfect manner and again submitted a copy of memorandum to Chairman, Hon!ble  Chairman  also gave positive assurances on most of the issues.

Meeting was ended in a very co-ordial environment.

P.J.C.A. MEETING

As decided earlier PJCA meeting was held at NFPE office, 1^st Floor North Avenue Post Office Building New Delhi-110 001 on 24.03.2015. at 2 P.M The meeting was Presided over by Shri. D.Theagarajan, Chairman, PJCA and Secretary General FNPO.

The meeting attended by both Secretary Generals and General Secretaries of both the Federations.

Before commencement of meeting homage was paid to Com. S.K. Vyas, a Veteran & legendry leader of Central Government Employees & Pensioners Trade Union Movement by observing one minute silence.

In the meeting Com. R.N. Parashar, Secretary PJCA and Secretary General NFPE presented the position of action and development on the 40 points Strike Charter of demands after PJCA meeting with Secretary (P) on 05.02.2015.

All General Secretaries presented their views and after a detailed discussion, the following decisions were taken:

1.         Disagreement was recorded on items No. 1,2,11,12,13,14,15,16,21, 25,27, 30, 31,33,34, 35,36,37, and 40 of PJCA Strike Charter of demand as the progress is not being noticed on all these items. Secretary (P) will be addressed to settle these issues as per the assurance given in meeting on 05.02.2015.

2.         Due to some unavoidable circumstances the date of Dharna in front of Dak Bhawan, New Delhi by All India leaders of both Federations is rescheduled as 29^th April-2015 instead of 15^th April.

3,         Notice for Indefinite Strike to be organized from 06^th May 2015 will be served to the Secretary, Department of Posts, New Delhi on 06^th April-2015. All Circle /Divisional and Branch Secretaries will also submit Strike Notice at all levels by organizing demonstrations in front of all important offices.

4          Campaign programme by All India Leaders of both the Federations affiliated unions has been finalized and it will be completed between 05th April to 15^th April, 2015 to mobilize entire rank and file. All concerned  will fix the dates in consultation with Circle  leadership and conduct the programme to mobilize  maximum employees to participate in Parliament March to be conducted on 28^th April 2015 under banner of National Council  JCM and to make them ready for the Indefinite  strike  from 06^th May 2015 onwards . (Campaign programme is enclosed)

5.         Next Meeting of PJCA will be held on 29^th April, 2015 on the day of Dharna by All India leaders in front of Dak Bhawan, New Delhi.

MEETING WITH PAY COMMISSION

1,         Meeting of NFPE leaders with 7^th Central Pay Commission was held on 25^th March, 2015 at Pay Commissions Office at Chhatrapati Shivaji Bhawan Qutub Institutional Area, New Delhi. Secretary General NFPE and all General Secretaries participated in the meeting and presented the issues very nicely submitted in the memorandums. Chairman and members appeared courteous and co-operative with positive attitude.

            GDS issues were also discussed by Secretary General NFPE and Com. P. Panduranga Rao General Secretary, GDS (NFPE) and Memorandum on GDS issue was also presented again to Chairman 7^th CPC by General Secretary GDS (NFPE) . Chairman assured all possible help to this most exploited and deprived section of Postal Workers within his capacity.

2.         Meeting of FNPO leaders was also held with 7^th CPC on 26^th March 2015 at CPC office at New Delhi. Secretary General & all General Secretaries presented the issues effectively and Pay Commission was also of positive views on most of the items.

PENSION PAYMENT FOR THE MONTH OF MARCH 2015 THROUGH POSB FUNCTIONING UNDER CBS – REGARDING

Sub: Pension payment for the month of March 2015 through POSB functioning under CBS – regarding.

Madam,

Your kind attention is invited to the fact that last year on 1^st April, 2014 no payment of pension could be disbursed through POSB on the request of Infosys due to some technical problems in the CBS. In fact all SB transactions were suspended on that day. Many pensioners were made to return home empty handed without drawing their pension on that day.

This year 1^st April is followed by two holidays on 2^nd and 3^rd April for Mahavir jayanthi and Good Friday and therefore any recurrence of previous problem on 1^st April will cause heavy hardships on pensioners as they could not draw their pension until 4^th April, 2015.

It is therefore requested to kindly intervene in the matter to prevent any such recurrence this year and if suspension of all SB transactions on 1^st April is unavoidable, then necessary instructions may please be issued to all concerned for effecting payment of pension on 31^st March, 2015 itself irrespective of the fact that no payment or pension payment is normally done on the closing day of the financial year.

Subject:-  Notice of One Day Strike on  26-03-2015 by Postal JCA (NFPE & FNPO) in Tamilnadu Circle.

                                    It has been intimated by the Circle Unions of Tamilnadu Circle that the Postal JCA (NFPE & FNPO) has submitted Strike Notice  on 10-03-2015 for One Day Strike on 26-3-2015 against the callousness of the Circle Authorities to resolve the following burning issues. Some of the items are given below:-

1.    Restore all the posts abolished in the name of ADR Plan (Annual Direct Recruitment)

2.    Stop harassment of Postman, MTS to procure more number of SB, RD Accounts and RPLI.

3.    Non holding of monthly Meeting with union representatives for the past two years at Foreign Post. Ensure regular meetings.

4.    Prepare Question Papers in Tamil for Postman to PA promotion exam.

5.    Restore checker-cum –cashier post immediately in all RMS Divisions.

6.    Irregular Rule 38 transfers given in RMS `T` Division should be withdrawn and all eligible officials should be considered without any irregularities.

7.    All MMS vehicles should be insured.

8.    Separate restroom for ladies and Gents officials working in all the RMS offices particularly CCRC Anna road Sorting.

                                    It has been intimated by the Circle Secretary Odisha Circle  that All India RMS & MMS Employees Union Gr.` C , MG, MTS & AIPEU –GDS `N` division Branch has decided to go on indefinite Strike w.e.f. 26-03-2015 from 6.00 AM against the unhelpful, nepotism, unruly, maladministration and discourteous behavior towards Divisional Secretaries of R-III & R-IV and other representatives on 12-3-2015 by  SSRM `N` Division Cuttack. Some of the problems are given below:-

1) To post the candidates(new recruit) of Cuttack city/Dist. & SC/ST candidates of Cuttack city in Cuttack RMS as per D.G order  No.60-9/2009-SPI3-1, Dtd.25/09/20 14, as all the candidates have taken in-house training for two weeks a

2) To fill up all vacancies of MTS/GDS as per orders of Department on PTCI and GDS.

3) To withdraw the hot and sentimental words like castism and other rough unparliamentary  languages to Dvl. Secy of R-lll & R-IV and representatives by the SSRM with apology.

4) To settle all the pending issues raised in the monthly meeting since long which are related to Division and in the purview of SSRM.

5) Demand to behave to Union  representatives properly, politely and in courteous manner.

Will the Minister of LABOUR AND EMPLOYMENT be pleased to satate :-

(a)whether it is a fact that many services of Government departments/ semi- Government/Public Sector are operated and delivered through outsourcing agencies and that the employees of such agencies are not provided adequate salary as per the Minimum Wages Act, medical facilities and PPF Schemes;

(b)if so, the reaction of Government and the mechanism existing with

Government to ensure payment of minimum wages to their employees as per the Minimum Wages Act; and

(c)the action taken against those outsourcing agencies for non-payment of minimum wages to their employees as per the Minimum Wages Act during last two years and the current year?

(a) to (c): Yes, Sir. The workers are engaged through agencies as per provisions of General Financial Rules. Under Minimum Wages Act (MW Act), if any short payment is detected then claim is filed before the authority by the officer in addition to filing of the prosecution against the outsourcing agencies in the court of law. Authority directs to pay the difference of actual wages paid and minimum rates of wages fixed under Minimum Wages Act, along with compensation. The details of the enforcement of the Minimum Wages Act, in the Central Sphere during the last two years and the current year are at Annexure.

JUSTICE DELAYED BUT DEFINITELY NOT DENIED

HONOURABLE SUPREME COURT ON

 (17.03.2015) HAS REPORTEDLY 

DISMISSED ALL SLPs

 FILED BY GOVERNMENT AGAINST 

PRE-2006 PENSIONERS

The Honourable Supreme Court of India has reportedly today dismissed all pending SLPs filed by the Government of India against implementation of CAT Principal Bench on the issue of Pre-2006 Pensioners. We also learn that the Government had reportedly requested for 4 months’ time for implementation to all pre-2006 pensioners.

All of you may be aware that the Government through its latest order of the Department of Pension & Pensioners Welfare tried to clarify as to why it had implemented only for S-29 Scale retirees and not for all other pre-2006 pensioners. In that order it had stated that unless and until the remaining three SLPs are not disposed of finally by the Apex Court, the Government will not implement the judgment of CAT Principal Bench for all pre-2006 pensioners.

The Government has finally met its waterloo today wherein the Apex Court has categorically dismissed all pending SLPS in this matter. There appears to be no other way for the Central Government now but to implement the pensioners favourable judgment to all categories of Pre-2006 Pensioners.

We hail the judgments of Honourable Supreme Court of India.

We hope the Central Government will at least now understand that it cannot for ever cheat the senior pensioners who toiled throughout their life for the service of Government.

This marks a great victory for the persistent struggle launched by several organisations of pensioners against the unjustified stand of the Central Government.

Even though this judgment will not bring Full Parity in Pension to all past and future Pensioners as we are continuously demanding since the retrograde recommendations of 6^th CPC were known, it is definitely a great victory on the face of misinterpretation of the 6^th CPC recommendation by a section of bureaucrats after initially accepting and ordering for implementation of pay commission recommendations to the extent of calculating minimum pension on the basis of  pay in the pay band of each cadre   instead of minimum of pay band.

This judicial victory prior to conclusion of enquiries by the 7^th CPC is expected to go a long way in favour of lakhs of pensioners in determining the pension for all past pensioners through the recommendations of 7^th CPC. We wish all Pensioners Organisations while submission of their oral evidence before the Pay Commission shall underline the importance of this judicial victory as well as to impress upon the Chairman of 7^th CPC for Full Parity in Pension to past and future pensioners.
