                   I am directed to refer to your letter No. R-III/52/42/2012 dated 9.5.2012 on the above mentioned subject and to inform that Government has provisionally approved amendment to the Constitution of All India  RMS & MMS  Employees Union Group `C`. The  amended version will now read as given below:

          The monthly subscription shall be Rs.40/- (Rs. Forty only). The subscription is payable in advance.

RECRUITMENT RULES, 2010	RECRUITMENT(AMENDMEND)RULES,2012
1. (1) These Rules may be called the Department of Posts (Postman and Mail Guard) Recruitment Rules, 2010. (2)They shall come into force on the date of their publication in the Official Gazette.	1. (1)These Rules may be called the Department of Posts (Postman and Mail Guard) Recruitment (Amendment) Rules, 2012. (2) They shall come in to force on the date of their publication in the Official Gazette.
	2. In the Schedule to the Department of Posts (Postman and Mail Guard) Recruitment Rules, 2010, against serial number 1 relating to the post of Postman,--
Column No.8 Matriculation or Equivalent from a recognized Board or University for direct recruitment from open market. No education qualification is prescribed for direct recruitment limited to Gramin Dak Sevaks.	(i) in column (8), in the entry, after the word “Matriculation”, the words “or Equivalent” shall be omitted.
Column No.11 (a)25% by promotion by selection of Multi Tasking Staff of the recruiting division; (b)25% on the basis of Limited Depart-mental Competitive Examination by promotion from amongst Multi Tasking Staff of the recruiting Division with three years regular service in the grade including service put in , if any, against an erstwhile Group’D’ post on regular basis as on the 1st January of the year to which the vacancy(ies) belong failing which by direct recruitment. (C)25% by recruitment on the basis of Competitive examination limited to Gramin Dak Sevaks* of the recruiting Division who have worked for at least five years in that capacity as on the 1stday of January of the year to which the vacancy(ies) belong failing which by direct recruitment; *Gramin Dak Sevaks are holders of Civil posts but they are outside the regular Civil Service due to which their appoint-ment will be by direct recruitment. (d)25% by direct recruitment from open market. Note:1: The scheme for Direct Recruit-ment shall be as per administrative instructions issued by the Department from time to time.	(ii)in column (11), the entry,- (A)for clauses (a) and (b) the following clause shall be substituted namely:- “(a)50% on the basis of Limited Departmental Competitive Examination by promotion from amongst Multi Tasking Staff of the recruiting Division with three years regular service in the grade including service put in, if any, against an erstwhile Group’D’ post on regular basis as on he 1st January of the year to which the vacancy(ies) belong failing which, from amongst Multi Tasking Staff of the neighbouring Division/Unit on the basis of the said Examination, failing which by direct recruitment from open market” (B)for clauses (c) and (d), the following clause shall be substituted, namely:- “(b)50% by direct recruitment on the basis of Competitive Examination Limited to Gramin Dak Sevaks* of the recruiting Division who have worked for  at least five years in that capacity as on the 1st day of January of the year to which the vacancy(ies) belong, failing which from amongst Gramin Dak Sevaks of the neighbouring Division/Unit on the basis of the said Examination, failing which by direct recruitment from open market. *Gramin Dak Sevaks are holders of Civil posts by they are outside the regular Civil Service due to which their appointment will be by direct recruitment.”;
Column No.12 (i)25% by promotion of Multi Tasking Staff of the recruiting Division with three years regular service in the grade including service put in, if any, against an erstwhile Group D post on regular basis. Note 1: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying/eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service. (ii)25% on the basis of Limited Departmental Competitive Examination by promotion from amongst Multi Tasking Staff of the recruiting Division with three years regular service in the grade including service put in , if any , against an erstwhile Group’D’ post on regular basis. Note 2 : [Applicable for (i) and (ii) above] : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1-1-2006 (the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended) shall be deemed to be service rendered in the corresponding pay/pay scale extended based on the recommendations of the Pay Commission. Note 3: The scheme for Limited Depart-mental Competitive Examination shall be as per administrative instructions issued by the Department from time to time.	(iii)in column (12), in the entry,- (A)for clause(i), Note 1 and clause (ii), the following clause shall be substituted, namely:- “50% on the basis of Limited Departmental Competitive Examination by promotion from amongst Multi Tasking Staff of the recruiting Division with three years regular service in the grade including service put in, if any, against an erstwhile Group’D’ post on regular basis as on the 1st January of the year to which the vacancy(ies) belong, failing which from amongst Multi Tasking Staff of the neighbouring Division/ Unit on the basis of the said Examination, failing which by direct recruitment from open market”; (B)”Note 2” shall be re-numbered as “Note 1” as so re-numbered, the brackets, words and figures” [Applicable for (i) and (ii) above]” shall be omitted; (C)”Note 3”shall be renumbered as “Note 2.”

ACCORDING TO AMENDED RECRUITMENT RULES, 2012:

50% -- MTS/GR.D - COMPETITIVE EXAMINATION ( 3 YEARS SERVICE)

50% -- GDS – COMPETITIVE  EXAMINATION  (5 YEARS SERVICE)

GOVERNMENT PLANS TO SEPARATE INDIA POST’S FUNCTIONS

The government is planning to separate the functions of policy making, regulations and operations of the over 150 year-old Department of Post (DoP)

.

Sources in Ministry of Communications and IT said Kapil Sibal has asked for setting up a body to oversee the unbundling of DoP's functions.

An independent body named Postal Development Board (PDB) will be responsible for the overall development and governance of the postal sector, they added. The PDB will also draw a road-map for unbundling of postal department functions

.

"The idea is to develop Indian postal sector as a full-fledged market, bring in more service providers to enhance employment and contribution to nation's GDP," a senior ministry official said.

A recent review meeting of the entire sector, chaired by Sibal, found that in some European countries' the sector contributes between 0.6-0.9 per cent of their GDP.

However, the contribution of the estimated Rs 15,000-crore Indian Postal sector is much lower. Private players have been demanding unbundling of the department's functions for a level-playing field and growth of the sector.

At present, DoP -- which has around 5 lakh employees -- is the sole body responsible for policy making, regulations and providing postal service.

The over 100-year old Indian Post Office Act, which governs the sector, bars any individual or entity from delivering letter for commercial purpose.

The business of private courier companies is built around delivering documents, parcels and others items which do not fall under the category of 'letter'.

Sibal has asked DoP to create a framework to support small and medium postal operators and new models to encourage entrepreneurship in the sector.

The minister has also instructed DoP to constitute a Postal Advisory Board (PAB) which should have representation from government, industry players, academics and other stakeholders.

The role of PAB will be to provide inputs to PDB on policy matters. PDB will be set up under Secretary (Posts) and will include Secretaries of Department of Economic Affairs, Department of Electronics and Information Technology, Department of Commerce and two members from Postal Services Board.

CONFEDERATION  CIRCULAR NO. 11    CONF/11/2012 DATED: 18.7.2012 REGRDING ACCOMMODATION

Dear Comrade,

                On the basis of the discussions, the President and Secretary General of the Confederation had with the leaders of various organisations in the Survey of India Department, it is decided to convene a meeting of the leaders of these organisations on 26^th July, 2012 at 4.00 PM  at New Delhi at Chugh dharamsala, udyan marg near Gole market , NEW Delhi 110 001 instead of 27^th in view of the MACP committee meeting which has been scheduled to take place at 11. 00 AM on 27^th.  The leaders of the Survey of India organisations are requested to make it convenient to attend the meeting as all of them are likely to be at Delhi on 26^th inst. 

                The affiliates and State Committees are requested to advise the comrades, who are deployed to participate in the March to Parliament programme to carry their banners, placards depicting the demands etc while marching to Parliament.  It has been decided to provide a badge to all the participants in the March.  The badges are getting printed at New Delhi.  The leaders who accompany the comrades from each State and affiliate are requested to kindly collect the same in bunch from the volunteers and distribute the same to the participants.  The March is to commence from a spot at the Jantar Mantar near to the intersection of Parliament Street, where the signal lights are installed.  There will be a banner of the Confederation and some volunteers on the spot.  Those who are to participate in the march are requested to kindly be on the spot latest by 10.00 AM.  The procession will commence at 11.30 AM to converge at the Parliament Street Police Station by 12 Noon.  The meeting will commence immediately thereafter.  A delegation will meet the Prime Minister either on the same day or on the day the appointment is given by the Prime Minister.

Those comrades who represent the State Committees and have not been provided with stay arrangements by their respective organisation/Association/Federation etc are requested to contact the Delhi State Committee Secretary, Com. Vrighu Bhattacharya (Phone No. 9868520926).  The CHQ has made arrangements for stay for a few comrades at Ambedkar Bhawan, which is near to New Delhi Railway Station. The Comrades, who represent Pensioners organisations may also avail of this accommodation.  The accommodation is booked for 25^th and 26^th and is to vacate on 27^th morning. 

                The comrades who are coming from nearby stations of Delhi, viz. Agra, Lucknow, Kanpur, Jaipur, Jodhpur, Chandigarh, Ambala, Gwalior, Ghaziabad etc. by hiring buses might require locations to park their buses.  The Delhi state Committee is discussing the matter with the Police Authorities.  We are trying to get some place nearby any Metro station, so that the comrades alighting from the buses can directly take the Metro to the Venue.  The nearest Metro Station is "Patel Chowk" and those who get down at Rajiv Chowk i.e Cannought place can walk through the Parliament street to reach the spot.

Dear Comrades,

                We have already placed a gist of discussions and decision of the 4^th National anomaly Committee meeting held today on agenda items that came up for consideration.  The Staff Side of the National Council met on 16^th.  The issue of the non functioning of the JCM at the Departmental level and the ineffectiveness of the council meetings wherever it meets were the subject matter of serious discussions at the Staff Side. The last meeting of the National Council was held in 2010.  The non acceptance of the arbitration awards, the inordinate delay in taking final view of items introduced as agenda by the official side and the non issuance of orders on agreed items, the refusal to record disagreement and refusal to refer the issue to arbitration etc. were raised by the members of the Staff Side.  It was therefore, decided that this issue should be taken up seriously by the leader and Secretary in their initial remark at the NAC meeting and should elicit concrete response from the official side. 

                Accordingly the Leader, Com. Raghaviah and Com. Umraomal Purohit, Leader and Secretary, Staff Side in their opening remakrs made a strong presentation of this issue and conveyed the growing resentment of the employees.  Both the Secretary General and President supplemented this presentation with further information and conveyed to the official side that while the non functioning of the Departmental Councils were restricted to a few Ministries in the past, as at present, it has been spread to almost all Ministries barring Railways, Defence and to a small extent to the Postal Department.

                The Chairman, while responding to this complaint said that he would elicit the information  from all Ministries/Departments as to when the last meeting of the Council was held, whether the Anomaly Committee had been constituted and if so what was the stage at which its deliberations are and monitor its functioning effectively and take up the grievance expressed by the staff in this regard with the highest authority in the Government to ensure that the machinery is brought to effective functioning system.

NATIONAL ANOMALY COMMITTEE MEETING

GIST OF DISCUSSIONS

                The 4^th meeting of the National Anomaly Committee was held on 5^th January, 2012.  All the items could not be discussed on that day.  The meeting was postponed and the same was held today on 17^th July, 2012.  The gist of discussions and decisions are given hereunder. 

Item No.1. Pay band of the merged pay scales: The demand to reconstruct the pay band in respect of merged pay scales (S8 to S10) by multiplying the minimum of the highest pay scales (6500-10,500) with 1.86 by virtue of which the pay band will commence with Rs. 12100 instead of 9300 is not agreed and as per the scheme disagreement has been recorded.

Item No.2. Extending the date for exercise of option:  Extending the date for exercise of option to come to the new pay scale as also to the next increment date on promotion was discussed at length.  While the official side will agree to reopen the promotional cases where such change of option becomes necessary on account of an unforeseen event, the question of extending the date in general will have to be examined.  In the case of necessity to change the option once exercised in view of the recent order on increment was raised by the Staff Side. The Official side agreed to issue a clarificatory order. 

Item No. 3. Special allowance and qualification pay: Order has been issued in respect of Auditors. In respect of SAS passed hands necessary orders will be issued shortly.

Item No.4. Fixation of pay in respect of Direct recruitees and promotees:  The official side agreed to consider grant of entry pay in all such cases, wherever the RR provides for direct recruitment. 

Item No.5. Date of next increment:  Orders have already been issued. Item is treated as settled.

Item No. 6. Grant of minimum pay of Rs. 5200 +1800 to temporary status employees:  Orders issued.

Item No. 7. Grant of revised allowance with effect from 1.1.2006:  The item has been withdrawn after discussion.

Item No. 8. Transport allowance:  The revision of transport allowance was not agreed upon.  However, taking a percentage of the TA for the purpose of OTA and grant of a portion of the TA in respect of persons on tour for more than one month at a stretch will be considered.

Item No. 9.  Doubling the Existing risk and patient care allowance:  The matter has been submitted to the Cabinet for its approval and orders are likely to be issued shortly. The Staff side raised the issue of doubling the daily allowance on tour. The Official side agreed to examine this matter also.

Item No. 10. Parity in Pension to pre 2006 retirees:  The matter is sub-judice. Therefore it could not be discussed.

Item No.11. Commutation of pension: The difference in the application of commutation table between the pre-2006 and post 2006 retirees was discussed.  It has been agreed that the difference would be quantified with reference to certain cases as an example.  If it has no implication on the post 2008 retirees, the Govt. may consider the acceptance of the demands of the Staff in the matter.

Restoration of commuted value of pension after 12 years instead of 15years would be considered in the light of the Supreme Court judgement of 1996, a copy of which would be made available to the Staff Side.

Item No.12. Grant of Rs.  5400/- to the Assistant Accounts and Audit Officers: To be discussed with the JS(per)/JS(E) separately. The date of the meeting will be fixed soon.

Item No.13. Revision base index for DA: The Staff Side will be provided with the computation made by the 6^th CPC in the matter and on the basis of the same the issue will be discussed further.

Item No.14. Child Care leave: Orders issued. Item treated as settled.

Item No.15. Income criterion for dependency of parents:  The item is dropped after discussion.

Item No. 16. Revision of Grade Pay fixation: After discussion, the item has been dropped.

Item No. 17. Reconstruction of Pay bands: dropped.

Item No. 18. Fixation of pay on promotion to the post carrying same grade pay and PB:  Agreed to grant one increment.

Item No. 19. All MACP items: will be discussed further in the subcommittee on 27^th July, 2012.

Item No.20. Anomaly in the grade pay of Library information Assistants: The official side will consider the  issue in consultation with the Ministry of Culture and take appropriate decision before the next meeting.

Item No.21. Anomaly in pension of those in receipt of stagnation increments in the pre revised scales of pay: The inclusion of stagnation increment for the purpose of fixation of pay in respect of the persons retired between 2006 and 2008, if not done, will be examined and suitable orders issued.

Item No.22. Anomaly in the pay scales of Stenographers of field offices with reference to Central Secretariat:  It was pointed out that Senior PS in the field offices were on identical pay scale of PPS  of the Central Secretariat and therefore, they must be granted grade pay of Rs. 5400 in PB3.   They have agreed to grant Grade pay of Rs. 5400 in PB.2 applicable to the field offices.  In respect of parity with Central Sectt, the proposal of Railway Board will be expeditiously examined by the Finance Ministry and suitable orders issued.

Item No.23.Date of Annual increment in EOL cases: Orders were issued earlier and the matter is treated as settled. The Staff Side raised the issue of denial of encashment of earned leave and half pay leave for industrial employees.  The official side agreed to issue clarificatory orders in the matter.

Item No. 24. Parity of PB and Grade pay for Official language personnel with the Central Sectt:  The official side said that orders have already been issued.  Wherever, the same is not implemented or different decision taken, the same may be brought to the notice of the Department of Expenditure for appropriate decision.  The proposal sent by the Railway Board will be considered separately.
